Definitions:

"Guests" means the consumer who purchases the goods and/or services

"Pacific Place" means Pacific Place Apartments

1. A deposit of $100 is required when making a reservation.



2. Christmas reservations require a 50% deposit.



3. All deposits paid to Pacific Place are non refundable, except under section (14) of the Terms and Conditions.



4. Bookings cancelled 30 days or more prior to arrival will have deposit refunded less 20% handling fee.



5. Bookings cancelled within 14 to 30 days of arrival will incur a cancellation fee of 50% of the amount of the booking.



6. Bookings cancelled 14 days prior or less means that the Guest is liable for the full balance.



7. In some cases deposits can be transferable to other dates with sufficient notice.



8. It is at Pacific Place full discretion as to what monies are refundable.



9. When a Guest rents an apartment or room the person(s) named on the booking confirmation are liable for any damage caused to the room or apartment. If any damage is caused to the apartment the Guest gives Pacific Place and/or the property authority to debit the Guests credit card for the costs of any repairs.



10. If a Guest arrives at the property and does not like the accommodation that they have chosen they will be liable for the full balance owed. Unless it can be proven without a reasonable doubt that they did not get what was promised on the Confirmation Letter or what was depicted on the website, with consideration to section (11).



11. All units are strata titled. This means that each apartment within is owned by a different person. Because of this the furnishings in each apartment can vary. On our website we have display a photo of a typical apartment. This is neither the best apartment nor the worst. The photos are used as a guide and neither Pacific Place nor the property can be responsible if your apartment does not look exactly like the photo.



12. All parties agree to abide by the terms and conditions.



13. The credit card holder gives Pacific Place authority to debit the credit card for any money owing from this booking in accordance with he above terms and conditions.



14. In the event of extreme hardship being caused to a Guest, in the opinion of Pacific Place, Pacific Place reserves the right to cancel a booking and relinquish all responsibility on money owing by the Guest to the client.
    
15. If Pacific Place elects to cancel a booking it is at the total discretion of Pacific Place as to whether a Guest receives a refund.



16. In the event that there is a problem with the products and services booked through Pacific Place, all Guests are to contact Pacific Place.



17. Where Guests neglects to pay the monies when owed, Pacific Place reserves the right to deem this as a cancellation and cancel the booking. Should this happen then the Guest forfeits their deposit if the booking is cancelled within 30 days of the date of the booking.



18. Any money refund that taken from a credit card that needs to be refunded incurs a 5% refund surcharge.
    
    
19. All parties agree that Queensland law governs this agreement and all proceeds should be filed in a Queensland Court. Should a proceeding be filed in a court located in any other state all parties agree to have the proceedings moved to the closest court to the head office of Pacific Place Apartments.
